Commissioner Accused of Misusing Power to Investigate Public Land Murders

In Kathmandu, the Supreme Court has rejected the writ petition filed by Dr. Sumitra Shrestha Amatya, the commissioner of the Commission for the Investigation of Abuse of Authority. The petition was related to Lalitpur Metropolitan City’s allegation that she had illegally operated a bulldozer within her residential compound back in June.

Following the filing of the writ petition on June 26, a joint bench of Justices Munendra Prasad Avasthi and Kailash Prasad Suvedi of the High Court had dismissed the case. The court had determined that Dr. Amatya had misused her authority in attempting to grab public land and that the operation of the bulldozer by the metropolitan city was legal. Moreover, the court had noted that there was an open passage to clear the area where the bulldozer was operated.

After being appointed as commissioner, the Amatya couple had purchased a house with a compound in the Saraswati Temple premises in Chakupat in October. However, controversies arose when they connected the purchased property, including an acre of land, with their compound after breaking the old boundary wall. This action led to public objections from locals, resulting in the metropolitan city operating a bulldozer in defiance of the objections.

In response to the bulldozing, Dr. Amatya had sent a letter to Mayor Chiribabu Maharjan, claiming that the mayor had been warned. A team from the authority had visited the mayor’s office in Pulchowk to deliver the letter, requesting him to provide a statement on the matter.
