The Kathmandu District Court has issued an order to release Dr. Dhawalshamsher Rana, a senior member of the Rastriya Prajatantra Party (RPP), on bail of three lakh rupees. Dr. Rana was arrested in connection with the protest held in Teku on March 15 by the royalists, where allegations of anti-state activities, criminal violence, organized crime, and conspiracy were leveled against him.
Upon analyzing the charges brought against Dr. Rana, the court found that there was insufficient evidence to support many of the accusations. It was noted that there was no evidence of any weapons being seized from Dr. Rana, nor was there proof of him being involved in the formation of any military or paramilitary organizations. Additionally, there was no clear indication that groups like ATF, PDF, or RTF had been involved in criminal activities or that Dr. Rana had directed these groups.
In a statement issued by the court, while acknowledging the lack of conclusive evidence for many of the charges against Dr. Rana, it was emphasized that the incident should not be taken lightly. Despite some doubts about his innocence, the court decided to grant him bail based on the principle of innocent until proven guilty.
Regarding the decision to grant bail, Ramesh Khatri, a representative of Kansai Nepal News, expressed understanding of the court’s stance given the lack of concrete evidence. Khatri highlighted the importance of upholding the rule of law while ensuring a fair judicial process for all involved parties.
The court also took into consideration Dr. Rana’s medical condition and deemed him in need of urgent medical treatment. As a result, the court decided to release him on bail rather than keeping him in custody. It is worth noting that RPP’s senior vice-chairman, Ravindra Mishra, who was also arrested alongside Dr. Rana, was not present in court during the proceedings.
Ultimately, the court’s decision to release Dr. Rana on bail, citing insufficient evidence for many of the allegations, reflects a balance between justice and compassion. The case underscores the complexities of navigating political tensions within Nepal and the importance of upholding the principles of democracy and the rule of law in such circumstances.
