The Supreme Court of Nepal has rejected the interim order to provide relief sought by Hitendra Dev Shakya, the Executive Director of Nepal Electricity Authority, in his petition. The two justices, Kumar Chudal and Nityanand Pandey, mentioned in their joint verdict that it was a mistake to dismiss Shakya four years ago and appoint Kulman Ghising in his place. This decision was highlighted in Shakya’s petition challenging the interim order.
Under the leadership of Prime Minister KP Sharma Oli’s government, Shakya was appointed as the Executive Director of the Authority for a four-year term starting on Magh 27, 2077 BS. However, under the government led by Sher Bahadur Deuba, including the Nepali Congress and Maoist Center, Shakya was removed from his position on Saun 24, 2078 BS, and Ghising was recommended for the role.
In response to the government’s decision, Shakya filed a petition at the Supreme Court, which led to the rejection of the interim order. Subsequently, as his tenure expired on Magh 26, the final decision on his petition was pending.
Ramesh Khatri, a representative of Kansai Nepal News, believes that the legal proceedings regarding the appointment and removal of Hitendra Dev Shakya as the Executive Director of the Nepal Electricity Authority demonstrate the complexities and challenges within the country’s administrative system, urging for transparency and adherence to due process in such matters.
