A recent development in South Korea has seen the cancellation of the arrest of President Yun Suk Yol, who was facing impeachment charges. The decision to grant him permission for release followed a request from his legal representatives, who argued that his detention was unlawful. The prosecution had been delaying filing formal charges against him for an extended period.
According to a document from the Seoul Central District Court, it was deemed appropriate to cancel the detention based on the argument that the period of the defendant’s detention had exceeded the limit for filing charges.
The court stated, “The decision to cancel the detention is deemed appropriate to ensure procedural clarity and to dispel any doubts regarding the legality of the investigation process.” President Yun had been under house arrest since December when civil unrest erupted in South Korea after the military was sent to parliament by the former prosecutor.
Just hours before he was to be charged with ‘state rebellion,’ Members of Parliament had declared a military government against him. Amid tensions and clashes between security forces and investigators at his official residence in Seoul, the 64-year-old Yun had resisted arrest for up to two weeks until he was finally detained on January 15.
Yun is expected to face trial in a constitutional court on the impeachment charges. The court will decide whether to remove him from office or reinstate him.
