In Kathmandu, a special court has made a decision that the repair of the silver spout in the sanctum sanctorum of the Pashupatinath Temple, which was done by replacing it with a gold spout, was not done illegally. The judgment was passed by the chairman of the special court Tek Narayan Kunwar and Justice Murari Babu Shrestha on the 18th of Baisakh.
The decision to dismiss the case against three individuals in relation to the spouts was deemed biased and prejudiced by the full text of the judgment recently made public by the court. The decision highlighted that there was no evidence of irregularities in the construction of the spout at the Pashupatinath Temple, surrounded by security forces including the Nepali Army, as alleged in the case filed on 14th of Ashoj 2080 by the Commission for the Investigation of Abuse of Authority.
The court ruling also stated that there was no inclusion of the mentioned 623 grams of gold in the spout, and the accusation of mixing other metals while constructing the 107-kilogram spout was not supported by any evidence or facts. The Secretary of the committee, Dr. Milan Kumar Thapa, former Secretary Dr. Pradeep Dhakal, Biset Naik, and Arun Kumar Shrestha were originally charged with opposition in the case. Dr. Thapa was the coordinator and treasurer of the committee during the construction of the spout.
The construction of the spout took place when KP Sharma Oli, the Chairman of the Nepal Communist Party (Maoist Centre), was the Prime Minister in 2077. After an investigation by the authorities, the spout, weighing 107 kilograms, was placed in the Shiva Lingam of the Pashupatinath Temple on the 13th of Ashar, 2080. The spout, made of gold, was placed in the sanctum sanctorum of the temple, where various security personnel were stationed.
The weight of the gold spout was recorded as 107 kilograms and 807 grams. Upon examination, it was found that the gold used in the spout was of 22-carat quality. The Commission had conducted measurements and quality tests on the gold spout placed in the Shiva Lingam of the Pashupatinath Temple on the 10th of Ashar, 2080.
Dr. Thapa, the Secretary of the committee, had raised objections regarding the controversy surrounding the gold spout in the sanctum sanctorum of Lord Pashupatinath and its impact on religious sentiments. However, the court upheld the decision, stating that despite the controversy surrounding the placement of the spout at the center of Hindu faith globally, the Special Court’s honorable judgment had addressed all these questions and ensured justice for Lord Pashupatinath.
